1. Introduction

Welcome to FunThinkers.com, an online educational platform designed to support students from Kindergarten through Grade 12 (K-12) in their academic journey, including preparation for Opportunity Class (OC) and Selective School tests. These Terms of Service (ToS) govern your use of our platform, including all services, content, and features. By accessing or using FunThinkers.com, you agree to be bound by these terms. If you do not agree, please do not use the platform.

2. Acceptance of Terms

By using the Services, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you are a parent or legal guardian, you represent that you have the authority to consent to these terms on behalf of your child.

3. Eligibility

The Services are intended for use by parents or legal guardians of students from Kindergarten through Grade 12 (K-12). By creating an account, you represent that you are the parent or legal guardian of the student for whom the account is created and that you have the authority to consent to the collection and use of the student's personal information as described in our Privacy Policy. Parental consent is required for all users under 18 years of age.

4. Account Usage

  • Account Creation: You must provide accurate and complete information during registration. Accounts are for personal use only and may not be shared.
  • Parental Supervision: Parents or legal guardians are responsible for supervising their children's use of the Services and ensuring compliance with these Terms.
  • Prohibited Actions: You may not share your account, use the platform for unauthorized purposes, or attempt to access, modify, or disrupt the platform's systems or data.

5. User Content

If you upload, post, or otherwise submit content to the Services (collectively, "User Content"), such as comments or reviews, you represent and warrant that you have all necessary rights to do so and that such User Content does not infringe on any third-party rights. You grant FunThinkers a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, modify, distribute, and display your User Content for the purpose of operating and promoting the Services. You agree that your User Content will be educational, appropriate for a K-12 audience, and free from any harmful, offensive, or illegal material. FunThinkers reserves the right to monitor, edit, or remove User Content that violates these Terms or is deemed inappropriate in its sole discretion.

6. Intellectual Property

All content on FunThinkers.com, including test questions, simulations, and the Janison-style interface, is owned by FunThinkers or its licensors and protected by intellectual property laws. You are granted a non-exclusive, non-transferable license to use the platform for personal, non-commercial educational purposes. You may not copy, distribute, modify, or create derivative works from the platform's content without written permission.

7. Use of Personal Information

By using the Services, you consent to the collection and use of your personal information, and if you are a parent or guardian, the personal information of your child, as described in our Privacy Policy. This includes using your child's username, profile picture, and first name in leaderboards and social posts on the platform to foster a sense of community and competition among students. Parental consent is required for such use, as outlined in our Privacy Policy.

8. Product, Payments and Refunds

  • Products: Any free trial, promotional products are to be used within 14 days. All paid products will expire after 90 days.
  • Products: We offer a variety of products and services, including test packs, subscriptions, and add-ons. Prices are subject to change and will be communicated at the time of purchase.
  • Refunds: Refunds are available for unused products within 7 days of purchase, in accordance with our Refund Policy. No processing fees are deducted from refunds. For more details, please see our Refund Policy.

9. Referral Program

We encourage you to refer friends and family to FunThinkers. When you refer someone who signs up and makes a purchase, both you and the referred user may receive a discount voucher for future purchases, in the form of a 10% or fixed-amount discount. These vouchers are not redeemable for cash. FunThinkers reserves the right to verify the legitimacy of referrals and determine eligibility for discounts. Discounts are subject to the terms of the referral program as outlined on the platform.

10. Privacy

Your use of the Services is governed by our Privacy Policy, which details how we collect, use, and protect your personal information, including that of your child. By using the Services, you consent to the collection and use of your child's username, profile picture, and first name for display on leaderboards and in social posts on the platform, as well as for other purposes described in the Privacy Policy.

11. Termination

FunThinkers may suspend or terminate your account for violations of these Terms or at its discretion, with notice where feasible. Upon termination, access to the Services ceases, and no refunds are provided for unused products.

12. Dispute Resolution

For issues with the platform, contact support@funthinkers.com. We aim to respond within 7 business days. These Terms are governed by the laws of New South Wales, Australia. Disputes will be resolved in NSW courts.

13. Limitation of Liability

FunThinkers is not liable for any indirect, incidental, or consequential damages arising from platform use, including loss of data or educational outcomes. Our liability is limited to the amount paid for the product or service, as permitted by law.

14. Changes to Terms

We may update these Terms of Service to reflect changes in our services or legal requirements. Updates will be posted on FunThinkers.com, and significant changes will be communicated via email or platform notifications. Continued use of the Services constitutes acceptance of the updated terms.
